Court Challenge to Australian Same-Sex Marriage Ban Unsuccessful

Only heterosexual couples may be married in Australia as a result of the federal Marriage Act defining it as between one man and one women.  An article on states that both Prime Minister, Julia Gillard, and Opposition Leader, Tony Abbott, are opposed to same-sex marriage and Pink News reports that a marriage equality bill introduced to Australian Parliament was defeated in September 2012.

The courts have not been a tool for change in this era. reports that a Federal Court judge has recently ruled that the marriage laws do not amount to discrimination based on gender because neither men nor women can be married to someone of the same sex.

According to, the ruling,  which upheld an Australian Human Rights Commission decision, asserted that same-sex couples do not have legal claims to marriage and will have to seek such rights through political means
